Welcome to A+ Intelligence! Please read these Terms & Conditions ("Terms", "Terms & conditions") carefully before using the A+ Intelligence platform website (the "Service") operated by A+ Intelligence ("us", "we", or "our").
1. For the Use of A+ Intelligence Services
These Terms & Conditions apply to individuals using A+ Intelligence services. In some cases, service usage may also be governed by a separate agreement between A+ Intelligence and the end user's employer or organization (the "Main Agreement"), which takes precedence over these Terms & Conditions. A+ Intelligence retains the right to modify these terms at its discretion. Any updates will be posted on aplusintelligence.com/terms, including the date of the most recent revision. Changes will become effective thirty (30) days after publication unless a later date is specified by A+ Intelligence.
2. General
It is crucial that you, as an end user, safeguard your login credentials for A+ Intelligence services. This includes details such as your username and password, which should not be shared with anyone, including colleagues or members of your organization. If you become aware of or suspect UNAUTHORIZED ACCESS TO OR USE OF A+ INTELLIGENCE SERVICES AND/OR YOUR LOGIN CREDENTIALS, you must notify A+ Intelligence immediately by emailing kontakt@aplusintelligence.com. FAILURE TO PROTECT YOUR LOGIN CREDENTIALS CAN RESULT IN DAMAGE TO BOTH YOU AND YOUR EMPLOYER OR ORGANIZATION. A+ INTELLIGENCE IS NOT LIABLE FOR ANY DAMAGE CAUSED DIRECTLY OR INDIRECTLY AS A RESULT OF FAILURE TO PROTECT YOUR LOGIN CREDENTIALS.Your employer or organization may have been granted ADMIN RIGHTS, allowing them to manage your account. These ADMIN RIGHTS include the ability to: (i) grant or revoke end users' access to the services.
3. Processing of Personal Data
To deliver and enhance A+ Intelligence services, A+ Intelligence may process your personal data. In doing so, the company complies with the European Parliament and Council Regulation (EU) 2016/679 (GDPR), which governs the protection of individuals regarding personal data processing and the free movement of such data. Additionally, A+ Intelligence adheres to the Swedish Data Protection Act (2018:218), which supplements and clarifies the application of GDPR within Sweden. A+ Intelligence also ensures that personal data processing aligns with the ePrivacy Directive (2002/58/EC) concerning electronic communications. For users protected by consumer rights legislation, A+ Intelligence applies the relevant sections of the Consumer Services Act (1985:716) and the Consumer Purchase Act (1990:932) to safeguard user rights and uphold fair treatment.
4. User Restrictions
When using A+ Intelligence services, the following actions are strictly PROHIBITED:Utilizing A+ Intelligence services in a manner that infringes upon or harms the rights of others.Sharing your A+ Intelligence account or transferring the right to use the services through sublicensing, renting, selling, or any other means, as well as allowing third parties to gain unauthorized access or benefit from the services.Attempting to decompile, reverse engineer, disassemble, or otherwise extract the source code, underlying algorithms, business logic, or any other confidential elements of A+ Intelligence services, unless explicitly permitted by applicable law. Any such UNAUTHORIZED ATTEMPTS WILL BE CONSIDERED A BREACH OF THESE TERMS & CONDITIONS AND MAY RESULT IN LEGAL ACTION.
When using A+ Intelligence services, the following actions are STRICTLY PROHIBITED:Creating derivative works of A+ Intelligence services by modifying, adapting, translating, or localizing them.Using automated methods to extract data from A+ Intelligence services unless explicitly authorized through an official API provided by A+ Intelligence.Attempting to gain UNAUTHORIZED ACCESS to A+ Intelligence systems, networks, databases, or other company resources. This includes, but is not limited to, bypassing security measures, using stolen login credentials, exploiting vulnerabilities, or employing automated tools or other techniques to manipulate or infiltrate our systems. ANY SUCH ACTIONS WILL BE CONSIDERED A SERIOUS VIOLATION OF OUR TERMS OF SERVICE AND MAY RESULT IN IMMEDIATE ACTIONS, INCLUDING LEGAL PENALTIES.Using A+ Intelligence services, data, technology, or resources to create, develop, or distribute products or services that compete with A+ Intelligence, either directly or indirectly. This includes, but is not limited to, conducting research, analysis, reverse engineering, or other activities intended to develop competing solutions.Introducing MALICIOUS SOFTWARE into A+ Intelligence’s network or systems.
When using A+ Intelligence services, the following actions are STRICTLY PROHIBITED:Applying for COPYRIGHTS OR PATENTS related to A+ Intelligence services or any part thereof.Disrupting, attempting to disrupt, or otherwise compromising the normal operation, security, availability, or performance of A+ Intelligence services. This includes, but is not limited to, system overloads, unauthorized access attempts, data manipulation, or the use of malicious code, scripts, or other technologies that could undermine the integrity of the services.Using the services to create, share, store, or distribute material that is OFFENSIVE, INAPPROPRIATE, ILLEGAL, INVASIVE, THREATENING, HARASSING, DISCRIMINATORY, or otherwise in violation of good conduct, applicable laws, and regulations.FAILURE TO COMPLY WITH THESE RULES WILL RESULT IN THE REMOVAL OF YOUR ACCESS TO THE A+ INTELLIGENCE PLATFORM.
5. Limitation of Liability
The end user is responsible for ensuring they possess all necessary rights, permissions, and consents to:
(i) upload material to A+ Intelligence platforms,
(ii) share material with A+ Intelligence, and
(iii) use the material within the scope of A+ Intelligence services.The user guarantees that any uploaded material does not violate intellectual property rights, privacy, or other legal rights of third parties and that all content complies with applicable laws and regulations.You are allowed to use material and information generated by A+ Intelligence services ("Output") for EDUCATIONAL PURPOSES, including:
(i) sharing corrected text analyses, and
(ii) using lesson material generated by A+ Intelligence with your students.
However, it is STRICTLY PROHIBITED to share, distribute, or otherwise use A+ Intelligence-generated material for COMMERCIAL PURPOSES, such as selling or publishing content. You are solely responsible for ensuring that your use of the material does not infringe upon any third-party intellectual property rights or other legal protections.Artificial intelligence and machine learning are rapidly advancing fields, and A+ Intelligence is continuously working to enhance its platform and features to improve accuracy, reliability, security, and overall usefulness.
Due to the probabilistic nature of machine learning models, A+ Intelligence services may sometimes generate incorrect or misleading output that does not accurately represent real people, places, or facts—a phenomenon known as "hallucination." These inaccuracies can be difficult to detect, as misleading responses may appear credible. Therefore, users are strongly encouraged to carefully review and verify all Output before relying on it in sensitive or critical contexts. IT IS ESSENTIAL THAT YOU THOROUGHLY EXAMINE ALL OUTPUT FOR ERRORS OR INCONSISTENCIES. A+ INTELLIGENCE SERVICES ARE DESIGNED AS A TOOL, AND A+ INTELLIGENCE DOES NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF THE GENERATED OUTPUT. A+ INTELLIGENCE DISCLAIMS ALL LEGAL LIABILITY FOR ANY CONSEQUENCES RESULTING FROM THE USE OF INFORMATION OR ADVICE OBTAINED THROUGH ITS PLATFORMS. THE USER BEARS FULL RESPONSIBILITY FOR HOW THE OUTPUT IS UTILIZED AND FOR ENSURING ITS ACCURACY AND APPROPRIATENESS FOR ITS INTENDED PURPOSE.
A+ Intelligence reserves the right to terminate your access to its platform if legislative changes, regulatory updates, or other legal factors render its operations unlawful, restricted, or financially unviable. In such cases, A+ INTELLIGENCE IS NOT LIABLE FOR ANY DAMAGE INCURRED BY YOU, YOUR EMPLOYER, OR YOUR ORGANIZATION DUE TO SERVICE RESTRICTIONS OR TERMINATION.
6. Intellectual Property Rights
All rights, ownership, and source code related to A+ Intelligence services are the exclusive property of A+ Intelligence. This includes, but is not limited to, all intellectual property rights as well as any modifications, updates, or improvements made to the services. These Terms & Conditions do not grant or transfer any such rights unless explicitly stated.A+ Intelligence does not claim ownership of any Input uploaded or shared by the end user through its services. However, by submitting Input to A+ Intelligence’s platform, the user grants A+ Intelligence the right to utilize it to enhance and further develop its services.All intellectual property rights arising from user-provided feedback, including but not limited to copyright under the Copyright Act (1960:729) and patent rights under the Patent Act (1967:837), are owned by A+ Intelligence in accordance with these laws and relevant contractual principles. Any feedback submitted, along with any rights derived from it, will not entitle the user to compensation, even if A+ Intelligence incorporates the feedback into its services.
7. Unforeseen Events
If an event beyond A+ Intelligence’s control impacts its services to the extent that continued operation becomes illegal, financially unviable, or otherwise unsustainable, A+ Intelligence reserves the right to terminate the agreement.A party’s obligation to fulfill this agreement, any related contracts, or purchase orders will be postponed for a reasonable period if performance is obstructed by an unforeseen event beyond the party’s control that cannot be avoided or mitigated. Such events include, but are not limited to, FORCE MAJEURE, nationwide labor disputes, riots, terrorism, war, or government-mandated requisition.In the event of FORCE MAJEURE, the affected party must IMMEDIATELY NOTIFY the other party in writing, specifying the nature, scope, and anticipated duration of the circumstances causing the disruption. Once the event has ended, the affected party must inform the other party and indicate when the delayed performance will resume.If a FORCE MAJEURE event lasts for more than thirty (30) days or is reasonably expected to do so, A+ INTELLIGENCE RESERVES THE RIGHT TO TERMINATE THIS AGREEMENT, EITHER IN WHOLE OR IN PART.
9. Applicable Law
Swedish law applies to these Terms & Conditions. Any disputes related to these terms will be resolved in general courts.
