Welcome to A+ Intelligence! Please read these Terms & Conditions ("Terms", "Terms & conditions") carefully before using the A+ Intelligence platform website (the "Service") operated by A+ Intelligence ("us", "we", or "our").
1. For the Use of A+ Intelligence Services
These Terms & Conditions apply to end users who utilize A+ Intelligence services. The use of the services may also be regulated by an agreement between A+ Intelligence and the end user's employer or organization (the Main Agreement). These Terms & Conditions are subordinate to the Main Agreement. A+ Intelligence reserves the right to revise these Terms & Conditions. If changes are made, the updated terms will be published on aplusintelligence.com/terms, along with the date of the latest update. The changes will take effect thirty (30) days after publication, or on a later date specified by A+ Intelligence.
2. General
It is very important for you, as an end user, to protect your login credentials for A+ Intelligence services. This includes, for example, your username and password, and you should not share this information with others, including colleagues or your organization. If you suspect or discover unauthorized access to or use of A+ Intelligence services and/or your login credentials, we ask you to contact A+ Intelligence immediately via email at kontakt@aplusintelligence.com. FAILURE TO PROTECT YOUR LOGIN CREDENTIALS CAN RESULT IN DAMAGE TO BOTH YOU AND YOUR EMPLOYER OR ORGANIZATION. A+ INTELLIGENCE IS NOT LIABLE FOR ANY DAMAGE CAUSED DIRECTLY OR AS A CONSEQUENCE OF FAILURE TO PROTECT YOUR LOGIN CREDENTIALS. Your employer or organization may have been granted administrative rights (Admin Rights) to manage your account. These Admin Rights include the authority to: (i) add or remove end users' access to the services.
3. Processing of Personal Data
To provide and improve A+ Intelligence services, A+ Intelligence may process your personal data. In such processing, A+ Intelligence adheres to the European Parliament and Council Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as the Swedish Data Protection Act (2018:218), which complements and specifies the application of the GDPR in Sweden. A+ Intelligence also ensures that the processing of personal data complies with the provisions of the ePrivacy Directive (2002/58/EC) on electronic communications, including the use of cookies and similar technologies to enhance services. For users who are covered by consumer protection legislation, A+ Intelligence applies the relevant parts of the Consumer Services Act (1985:716) and the Consumer Purchase Act (1990:932) to protect users' rights and ensure fair treatment.
4. User Restrictions
When using A+ Intelligence services, it is prohibited to: Use A+ Intelligence services in a way that infringes on others' rights or abuses them. Share your A+ Intelligence account or the right to use A+ Intelligence services through sublicensing, renting, selling, or in any other way, or allow third parties to benefit from the services. Attempt to decompile, reverse engineer, disassemble, or otherwise derive the source code, underlying algorithms, business logic, or other confidential aspects of A+ Intelligence services, unless expressly permitted by applicable law. Any such unauthorized attempts will be considered a violation of our Terms & Conditions and may result in legal action.
Create derivative works of A+ Intelligence services by modifying, adapting, translating, or localizing. Use automated methods to extract data from A+ Intelligence services, unless expressly permitted via an API from A+ Intelligence. Attempt to gain unauthorized access to A+ Intelligence systems, networks, databases, or other resources belonging to the company. This includes, but is not limited to, attempts to bypass security measures, use stolen login credentials, exploit security flaws, or use automated tools or other techniques to manipulate or infiltrate our systems. All such actions constitute a serious violation of our Terms of Service and may lead to immediate actions, including legal penalties. Use A+ Intelligence services, information, technology, or resources to create, develop, or distribute products or services that compete with our offerings, whether directly or indirectly. This includes, but is not limited to, using our services for research, analysis, reverse engineering, or other activities that could lead to the development of competing solutions. Introduce malicious software into A+ Intelligence's network or systems.
Apply for copyright or patents involving A+ Intelligence services or parts of them. Disturb, attempt to disturb, or otherwise compromise the normal operation, security, availability, or performance of A+ Intelligence services. This includes, but is not limited to, actions such as system overloads, attempts to gain unauthorized access, data manipulation, or the use of malicious code, scripts, or other technologies that could affect the integrity of the services. Use the services to create, share, store, or otherwise distribute material that is offensive, inappropriate, illegal, invasive, threatening, harassing, discriminatory, or otherwise in violation of good conduct, laws, and regulations. Failure to comply with these rules will result in the removal of your access to the A+ Intelligence platform.
5. Limitation of Liability
The end user is responsible for ensuring that they hold all necessary rights, permissions, and consents to: (i) upload material to A+ Intelligence platforms, (ii) share material with A+ Intelligence, and (iii) use the material within the scope of A+ Intelligence services. The user guarantees that this material does not infringe upon the intellectual property rights, privacy, or other legal rights of third parties and that all uploaded material complies with applicable laws and regulations. You are permitted to use material and information generated and provided by A+ Intelligence services ('Output') for educational purposes, including: (i) sharing corrected text analysis, and (ii) using lesson material generated by A+ Intelligence with your students. However, it is prohibited to share, distribute, or otherwise use material created by A+ Intelligence for commercial purposes, such as sales or publishing. You are fully responsible for ensuring that your use of the material does not infringe on any third-party intellectual property rights or other legal rights. Artificial intelligence and machine learning are rapidly evolving technologies, and A+ Intelligence continuously works to improve its platform and features to make them more accurate, reliable, secure, and useful.
Due to the probabilistic nature of machine learning models, the use of the services may, in some cases, result in incorrect or misleading output that does not accurately reflect real people, places, or facts – this phenomenon is called 'hallucination.' Hallucinations can be difficult to detect, and incorrect or misleading answers may sometimes appear correct. Users are therefore urged to carefully review and verify all Output before using it in sensitive or important contexts. IT IS THEREFORE VITAL THAT YOU CAREFULLY REVIEW ALL OUTPUT FOR ANY ERRORS OR INCONSISTENCIES. A+ INTELLIGENCE SERVICES ARE INTENDED TO BE USED AS A TOOL, AND A+ INTELLIGENCE CANNOT GUARANTEE THE ACCURACY OR COMPLETENESS OF THE GENERATED OUTPUT. A+ INTELLIGENCE DISCLAIMS ALL LEGAL LIABILITY FOR ANY CONSEQUENCES ARISING FROM USING INFORMATION OR ADVICE DERIVED FROM ITS PLATFORMS. THE USER IS FULLY RESPONSIBLE FOR HOW THE OUTPUT IS USED AND FOR ENSURING IT IS CORRECT AND SUITABLE FOR ITS PURPOSE. A+ Intelligence reserves the right to terminate your access to the A+ Intelligence platform if legislation, guidelines, or other regulations change in a way that makes A+ Intelligence's operations illegal, prohibited, or economically unsustainable. In such a case, A+ Intelligence is not liable for any damage caused to you, your employer, or your organization due to the restriction or termination of services.
6. Intellectual Property Rights
All rights, ownership, and source code related to the services belong to A+ Intelligence. This includes, but is not limited to, all intellectual property rights as well as any changes, updates, and improvements. These Terms & Conditions should not be interpreted as a transfer or license of such rights, except in cases where explicitly stated in the terms. A+ Intelligence does not claim ownership of the Input that the end user uploads or shares through its services. By transferring Input to A+ Intelligence's platform, the user grants A+ Intelligence the right to use it to further develop and improve its services. All intellectual property rights arising from feedback, including but not limited to copyright under the Copyright Act (1960:729) and patent rights under the Patent Act (1967:837), belong to A+ Intelligence in accordance with these laws and the rules of contract law. Feedback and any rights arising from it will not result in compensation to the user, even if the feedback is implemented by A+ Intelligence.
7. Unforeseen Events
If an event beyond A+ Intelligence's control affects A+ Intelligence's services in such a way that the operation becomes illegal, unprofitable, or otherwise unsustainable, A+ Intelligence reserves the right to terminate the agreement. A party's obligation to fulfill this agreement, any connection agreements, or purchase orders shall be extended for a reasonable period if fulfillment is hindered by an unforeseen event outside the party's control, which cannot be avoided or prevented. This includes, but is not limited to, force majeure, nationwide labor disputes, riots, terrorism, war, or requisition (according to government decisions). If a Force Majeure event occurs, the affected party, in order to be entitled to extend the time for performance according to the agreement, must immediately notify the other party in writing and specify the nature and extent of the circumstances giving rise to the Force Majeure event and its likely duration. Once the Force Majeure event has ceased, the other party shall be notified of this and informed when the performance delayed due to the Force Majeure event will resume. If a Force Majeure event continues for more than thirty (30) days, or if such an event is expected to continue for such a period, A+ Intelligence reserves the right to terminate this Agreement in whole or in part.
9. Applicable Law
Swedish law applies to these Terms & Conditions. Any disputes related to these terms will be resolved in general courts.
